What is obligatory upon one who performed Hajj and forgot to fast the ten days?

Machine translationRead the Arabic original
Question:
A listener from Egypt residing in Iraq, his brother Sayyid Ibrahim Murayri, sent two questions. He says: I performed Hajj at the Sacred House of Allah in 1978 CE, and I completed all the rituals of Hajj, but I forgot to fast three days during the obligatory Hajj, and seven days after performing the obligation.

The Shaykh: Repeat.

The presenter: He says: I performed Hajj at the Sacred House of Allah in 1978 CE, and I completed all the rituals of Hajj, but I forgot to fast three days during the obligatory Hajj, and seven days after performing the obligation, knowing that I did not know or realize about fasting these days. So should I fast these days, or is there an expiation for them? Please inform us, may Allah reward you with good.

Answer:
If you entered the state of ihram from the miqat for the House with both 'Umrah and Hajj, or with 'Umrah and then for the House with Hajj afterwards; then you must fast these days, unless you are able to offer the hady, meaning: a sheep from the sheep: a one-year-old ram or a two-year-old goat, you entrust someone to slaughter it in Makkah in the Sacred Precinct for the poor; for that is the obligatory hady upon you. If you are unable to afford a head of sheep to be slaughtered in Makkah, nor a seventh of a camel, nor a seventh of a cow to be slaughtered in Makkah; then you fast ten days in your country, and that suffices you.
As for if you only entered the state of ihram for the House with Hajj alone, you entered ihram for Hajj alone as an ifrad; then there is no fasting nor hady upon you; because the hady is only obligatory upon one who performs tamattu' with 'Umrah to Hajj. As for the ifrad who did not enter ihram except for Hajj alone, then he owes nothing according to all the scholars of knowledge. Yes.

The presenter: May Allah reward you with good. So fasting is not upon every pilgrim in this situation.

The Shaykh: It is upon one who entered ihram with 'Umrah and Hajj together, or with 'Umrah then ... Hajj.. or with 'Umrah, meaning: and he exited from it then entered ihram for Hajj, meaning: the mutamatti' and the qarin.

The presenter: The mutamatti' and the qarin.

The Shaykh: The one who entered ihram for 'Umrah from the miqat, then exited from it and entered ihram for Hajj in his year in the months of Hajj, or entered ihram for both together, or entered ihram for 'Umrah alone and then on the way he responded with the talbiyah for Hajj with it, this is called a qarin. And the one who exited from it and enjoyed it, then entered ihram for Hajj in its time, for example on the eighth day; this is called a mutamatti' by the scholars. These are the ones upon whom the hady is obligatory. The one who entered ihram for 'Umrah with Hajj together, or with 'Umrah then added Hajj to it, or with 'Umrah and exited from it, he performed tawaf and sa'y and shortened his hair after Ramadan and exited from it, then entered ihram for Hajj in its time in his year, yes, this is the one called a mutamatti', even the qarin is called a mutamatti'. This is the one upon whom the hady is obligatory, and it is a head of sheep: either a one-year-old ram, or a two-year-old goat, or a seventh of a camel, or a seventh of a cow, to be slaughtered in Makkah in the Sacred Precinct, and distributed to the poor of the Sacred Precinct. Yes.

The presenter: So fasting is not in every case whatsoever.

The Shaykh: No, no.

The presenter: In one case and not another.

The Shaykh: Fasting is upon the mutamatti' and the qarin if they are unable to offer the hady.

The presenter: If they are unable to offer the hady.

The Shaykh: If they are unable to offer the hady. Yes.

The presenter: May Allah reward you with good.
