Question:
In the last of the questioner’s questions from Yemen, he says in this question: I hope that His Eminence the Shaykh will inform us about women’s jewelry, and whether there is zakah on it or not; because we hear some people say that there is zakah on it. And if it is intended for adornment, does the woman have to pay zakah on it? And if she does have to pay zakah on it, what is the amount on which zakah is paid? And if she does not have money, does the husband, or the father, or the brother pay zakah on her behalf? And is it permissible for her to sell some of it and pay zakah from it?

Answer:
The zakah of jewelry is a matter of disagreement among scholars, and the stronger and more correct view, as it appears to me from the indications of the Sharia evidence, is that zakah is obligatory on jewelry of gold and silver. This is what I have issued as a ruling for a long time, and I have not issued any other ruling. It is that zakah is obligatory on jewelry if the gold reaches the nisab or the silver does, and the nisab is twenty mithqals of gold, and one hundred and forty mithqals of silver. The amount of that is eleven and three-sevenths of a Saudi pound of gold, and fifty-six silver riyals of silver, or the equivalent in paper currency. And if the wife is unable to pay zakah because she has no money to sell from and pay zakah, and if her husband pays zakah on her behalf with her permission, that is sufficient, and praise be to Allah. If her husband, or her father, or her son pays zakah on her behalf with her permission, that is sufficient. Otherwise, she must pay zakah, either by borrowing from others, or by selling some of it and paying zakah. Yes.
