Question:
If a person knows that his deceased relative acquired wealth or land through usurpation or theft, is it permissible for that heir to inherit it, return it, or give it in charity?

Answer:
It is obligatory for the heir to return it to its owner if he knows who the owner is. As for if he does not know the owner, he should give it in charity on his behalf. It is a debt upon the deceased, and the debt is upon the heir. He is not permitted to benefit from it as long as he knows that it was usurped or stolen. Therefore, it is obligatory to return it to its owner if he knows him, or otherwise to give it in charity in the causes of good, with the intention that it is on behalf of the owner. Yes.
