The Ruling on Zakah of Worn Jewelry

Machine translationRead the Arabic original
Question:
The questioner from Yemen, in her final question, says: “O Shaykh, is there zakah in a woman’s jewelry that is used for adornment?”

Answer:
There is scholarly disagreement regarding gold and silver jewelry. Many scholars hold that there is no zakah in it because it is used and not intended for increase. Other scholars hold that zakah is due in it, which is the more correct and stronger position. If it reaches the nisab and a lunar year has passed over it, then zakah is due in it. This is because the Prophet (peace and blessings be upon him) ordered a woman who had jewelry to pay the zakah. When Umm Salamah presented her jewelry to him and asked, “Is there zakah in this?” he said:
Whatever reaches the amount where zakah is due, if zakah is paid on it, it is not a treasure.ما بلغ أن يزكى فزكي فليس بكنز
When she said to him, “Is this hoarded wealth?” he said:
Whatever reaches the amount where zakah is due, if zakah is paid on it, it is not a treasure.ما بلغ أن يزكى فزكي فليس بكنز
This indicates that jewelry is subject to zakah, and that if it is not paid, it is considered hoarded wealth. This is the stronger position and the more cautious one. Yes.

The presenter: May Allah reward you.

The Shaykh: If the jewelry reaches the nisab in gold or silver, yes.
