Guidance for one who favors the children of his second wife over those of the first

Machine translationRead the Arabic original
Question:
The questioner says: The second issue in my letter, O honorable Shaykh, is the discrimination between my children. This husband is married to a second woman, and he favors his children from the second mother—from the second wife—and loves them greatly and shows them affection. As for me, I am neglected, and my children are greatly neglected. She asks: What is the guidance of Your Eminence?

Answer:
It is obligatory for the husband to be just between the two wives, or three, or four. Justice is required of him, and justice is required of him toward his children as well. This is what is obligatory for the husband, and he should fear Allah in this matter. Allah says:
And live with them in kindnessوَعَاشِرُوهُنَّ بِالْمَعْرُوفِ
[Surat al-Nisa: 19]. And He, the Exalted, says:
And due to the wives is similar to what is expected of them, according to what is reasonableوَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ
[Surat al-Baqarah: 228]. So it is obligatory for him to be just and to seek justice, and likewise with his children. The Prophet (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children.اتقوا الله، واعدلوا بين أولادكم
Sahih al-Bukhari 2587
.
So he has no right to be unjust, such as giving the children of one wife what he does not give the children of the other, or addressing them and being gentle with them with kind words, while the others are treated differently. This is not permissible. Rather, it is obligatory for him to be just in his speech, in his actions, and in his wealth.
And likewise with the two wives, he must be just between them in his division between them, in his address to them, and in not oppressing one of them, or any of them if there are three or more. It is obligatory for him to be just in his speech, his conduct, his treatment, and his financial maintenance if they are equal. And the children likewise; he must be just between them, and he has no right to give something to some of them exclusively. The Prophet (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children.اتقوا الله، واعدلوا بين أولادكم
Sahih al-Bukhari 2587
.
So if he gives to the child of so-and-so, he must give the same to the child of the other, unless they are mature and they are lenient with him. If they are mature and they forgive him, saying, "We forgive you, O father," and they forgive him, and they are mature, then there is no harm. Otherwise, it is obligatory for him to be just
for the male, what is equal to the share of two femalesللذكر مثل حظ الأنثيين
[An-Nisa 4:11]
. So if he gives the child of so-and-so one hundred, he gives the other one hundred. If he gives him a thousand, he gives him a thousand. And the female gets half of that; if he gives the male one hundred, he gives her fifty, and if he gives the male a thousand, he gives her five hundred. This is what is obligatory. And if the two wives are equal in financial maintenance, he spends on them equally. But if one of them has more children, he spends on each according to her need.
