The Ruling on What Is Called Cooperative Associations

Machine translationRead the Arabic original
Question:
After this, a message reached the program from Makkah al-Mukarramah, sent by a listener from there. He says: Your brother in Allah (J. H. S). Our brother asks your Eminence, saying: What is the ruling on dealing in associations among a number of colleagues at work? For example: five people agree to form a cooperative association with an amount of two thousand riyals, and the amount, which is eight thousand riyals for instance, is delivered to the first person according to the agreed order, and the second person is delivered the same amount until the end of the five months. I ask you to issue a ruling on this matter, and does this fall under the category of a loan with a benefit? May Allah reward you with good.

Answer:
If the loan is without an increase, rather they agree on a known loan among themselves, two thousand to one person each month, or one thousand, or less, or more, there is no harm in this. A decision has been issued by the Council of the Senior Scholars permitting this if it is without an increase, yes.

The presenter: May Allah reward you with good. He asks: Is it a loan with a benefit, or not?

The Shaykh: It is not of that; because they are equal, there is no condition for one over another, and there is no benefit for one over another, yes.

The presenter: May Allah reward you with good. The matter, O Shaykh, is that if a person wants to participate with them, but without paying an amount for them to lend to him, they do not do that, so what is your guidance?

The Shaykh: If they wish to lend to him for nothing, it is a known favor from them, may Allah reward them with good, for nothing, without...

The presenter: They do not lend to him unless he is a partner with them.

The Shaykh: There is no harm, this is a condition among them, there is no blame, they do not lend except to one who has partnered with them.

The presenter: Yes.

The Shaykh: There is no harm in that.

The presenter: This is not of the benefit mentioned...

The Shaykh: No, no, it does not harm; because this is a benefit in which there is no increase, there is no consideration, they are all equal in it.

The presenter: They are all equal, may Allah reward you with good.
