Question:
He says: It is customary in some countries for the first marriage contract to be written by what is known as the marriage officer (al-ma'adhun), such that the hand of the agent for the girl is placed, and the hand of the suitor, and the acceptance and offer are completed, in the presence of a group of Muslims. Is that sufficient, or is it necessary to wait until the night of the wedding? May Allah reward you with good.

The contract is permissible at any time, even if it is a long time before the marriage, and even if it is a long time before the consummation. There is no need to place hands, and this is not prescribed. What is prescribed is that he says: "I give you in marriage." The wali (guardian) says this to the husband: "I give you my daughter in marriage," or "my sister," or "my cousin's daughter," the one for whom he is the wali. And the husband says: "I accept this marriage." This is what is prescribed in the presence of two just witnesses. That is sufficient, ...... at the marriage officer, or at someone other than the marriage officer, at the marriage officer, or at the judge, or in any place.
The wali says to him: "I give you my daughter in marriage," or "my sister," or "my other ward, his cousin's daughter," or something similar. And the husband says: "I accept this marriage, and I am pleased with it." This is the recommended practice (sunnah) in the presence of two witnesses, if the woman is free from impediments, and the husband is free from impediments, meaning: they are free from impediments. The wife is a virgin, or a woman in the waiting period who has completed her waiting period, and the husband has no impediment. He is a Muslim and she is a Muslim, or he is a Muslim and she is a People of the Book, there is nothing wrong with that.
The point is: they must be free from impediments. There is no impediment in the husband, and no impediment in the wife. And it is done with the offer and the acceptance, in the presence of two just witnesses, at the marriage officer, or at the judge, or in the house of the wali, or in the house of the husband.
