The Shaykh : They will not be able to implement it in Kabul, and you are with me on this?

The Shaykh : No, no, I can save you the trouble of asking now, because the one who needs to ask this question has not yet provided the answer beforehand. What is the alternative? I will give you the alternative now, and it is: if Allah grants them victory, as we hope, and we also hope that this will be soon, that they derive the correct knowledge from the scholars and those with knowledge of the Book and the Sunnah, and upon the methodology of the righteous Salaf in the Islamic world. They should not be content to make it regional, saying "this is an Afghan state," as is the reality, unfortunately, in all the lands of Islam today. Do you know or not?
The student : Yes, yes.

The Shaykh : Ah, so if they do this, then this is their obligation. But if they continue to apply the legal rulings, I will give you an example. For instance, in the Hanafi school, a Muslim is killed in retaliation for a disbeliever. And in "Sahih al-Bukhari":
A Muslim is not killed in retaliation for a disbeliever لا يُقتل مسلم بالكافر
Do you see? This is what they want to put in place, or shall I say, imagine for us Professor Abu al-A'la al-Mawdudi (may Allah have mercy on him) and forgive us and him. He has a book, perhaps titled "The Islamic Constitution" or something similar, in which he explicitly stated that in the Islamic system, if a Muslim kills a dhimmi, he is killed in retaliation, and if he kills a dhimmi by mistake, his blood money is the blood money of a Muslim. He is affirming the Hanafi school, because one who lacks a thing cannot give it. So, if it is Hekmatyar, whom I described as a military man and nothing more, or if it is Sayyaf, whom I think is at a much higher level of culture and Islamic knowledge than Hekmatyar and others, in any case, they are Hanafis. So, they will make it part of the Islamic governance system in Kabul that a Muslim is killed in retaliation for a disbeliever. Why? Because he is a dhimmi living under an Islamic banner, and if he is killed by mistake, his blood money is the blood money of a Muslim. All of this is contrary to the correct Sunnah. We do not want this. Well, they do not know! We excuse them, but we do not excuse them at all if they are content with the knowledge of their scholars, and they want, as Allah al-'Azam (may Allah have mercy on him) used to declare, that this is a nucleus for applying Islamic rule in all the Islamic lands. Do you see if he meant the Hanafi school? I do not think so. And Allah al-'Azam (may Allah have mercy on him) used to attend our lessons, and he was perhaps more diligent than many of our brothers; he had a small notebook like this and a small pen and would record the main points. I used to see him holding it in many Salafi issues. But he was not a jurist in Salafi jurisprudence. He did not have a place in the house because the Ikhwan (Brotherhood) tendency dominated him, although later in some of his articles, it seemed as if he disavowed them.

The Shaykh : And so on. But my point is to say: one who lacks a thing cannot give it. I often ask a questioner, "What is your opinion on such and such?" We need a discussion. And he may be a student of knowledge, or a scholar, or a doctor, or so on. Well, if you do not know, what is your obligation? He remains silent. I say, your obligation is that you are one of two people, as He (Glorified and Exalted is He) said:
So ask the people of the message if you do not know. فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ
[An-Nahl 16:43]
So you declare that you do not know, so what is your obligation? To ask the one who knows. So we are now talking about the alternative that you asked about, "Where is the alternative?" The alternative, my professor, is that even if hundreds of people who are more knowledgeable than me in the Book and the Sunnah and the methodology of the righteous Salaf went there, do not think that the matter will be fixed in five or ten years. And this will not happen, because it is not happening during times of rest and residence in the Islamic groups. So do you think that what we hope for and you hope for will happen during times of jihad, fighting, and battles? No. But its existence, without a doubt, as I said, is better. So what is the alternative you asked about? The answer is:
So ask the people of the message if you do not know. فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ
[An-Nahl 16:43]
