Q: A question from a Somali student studying in China, in which he says: I am a Somali student studying in China, and I face many difficulties regarding food in general and meat in particular. The problems are:
1- I heard before coming to China that the animals slaughtered by the atheists, or rather killed by them, are not permissible for a Muslim to eat. We have a small restaurant for Muslims at our university, and there is meat in it, but I am not certain that it was slaughtered in the Islamic manner, and I am doubtful about it. My classmates are not as doubtful as I am and they eat from it. Am I right, or are they eating what is forbidden?
2- Regarding food utensils, there is no distinction between the utensils of Muslims and those of others. What should I do regarding these matters?

A: It is not permissible to eat the slaughter of disbelievers other than the People of the Book, namely the Jews and the Christians, whether they are Zoroastrians, polytheists, communists, or any other type of disbeliever. Nor is it permissible to eat what is mixed with their slaughter, such as broth and the like. This is because Allah the Exalted has not permitted us to eat from the food of disbelievers except the food of the People of the Book, as He the Mighty and Majestic said:
This day [all] good foods have been made lawful, and the food of those who were given the Scripture is lawful for you and your food is lawful for themالْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ وَطَعَامُكُمْ حِلٌّ لَهُمْ
[Al-Ma'idah: 5]. Their food is their slaughter, as Ibn Abbas and others said.
As for fruits and the like, there is no harm in them, because they are not included in the forbidden food. As for the food of Muslims, it is lawful for Muslims and others, provided they are truly Muslims who worship none but Allah and do not invoke with Him any other of the prophets, the awliya (close friends of Allah), the people of graves, or anything else that the disbelievers worship.
As for utensils, it is obligatory for Muslims to have utensils other than the utensils of the disbelievers in which they use their food, their intoxicants, and the like. If they do not find any, it is obligatory for the Muslim cook to wash the utensils used by the disbelievers and then place the food of Muslims in them. This is based on what is established in the two Sahihs from Abu Thalhah al-Khushani (may Allah be pleased with him) that he asked the Prophet (peace and blessings be upon him) about eating in the utensils of the polytheists, and the Prophet (peace and blessings be upon him) said to him:
Do not eat from them unless you do not find anything else, then wash them and eat from them.لا تأكلوا فيها إلا أن لا تجدوا غيرها، فاغسلوها وكلوا فيها
. And may Allah send prayers and peace upon Muhammad, his family, and his companions.
