The first question we pose to his Eminence was sent to us from the listener (N. S. Sh.) from Makkah al-Mukarramah. He says: When I was sixteen years old—that is, about seven years ago—I was involved in a car accident in the car I was driving, with my father (may Allah have mercy on him), my sisters, and some of my relatives. I was driving my father’s car at a moderate speed, and suddenly the front tire struck something. I did not know what happened to me, for I fainted and was unaware of anything. I did not regain consciousness until we were in the ravine. My father suffered internal bleeding and passed away. My question is: Am I considered a deliberate killer in this case, meaning is it obligatory for me to fast two consecutive months? And what should I do so that Allah forgives me this great sin? I have vowed to myself to stay with my siblings and care for them until the youngest among them. I seek forgiveness from Allah the Great, who by divine decree placed me in this difficult situation. Yes?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance.
As for the answer, O questioner! You should know that the matter lies in the responsibility of those like you, and you are best aware of the reality. If you know that the accident was caused by your speeding, or because the tire was defective and you were negligent in not replacing it, or due to other causes, then the expiation is upon you, and the blood money is also upon you.
However, if you do not know any of that, and you were driving at a moderate speed like everyone else, with nothing exceeding the usual driving, and you did not know of any defect in the tire, and there was no harm in it, then nothing is upon you. This is because you did not cause the accident, and the decree of Allah prevails over everyone; it was the decree of Allah, and He did what He willed. It is like if a person were on a mount with his brother or his father, and it stumbled or became frightened, and one of them or both fell and one died; nothing would be upon the rider in this case due to the lack of causation. So, if the car overturns due to a cause not related to the driver, then nothing is upon the driver; because he did not neglect his duty and did not transgress. But if you sped at an excessive, dangerous speed, then the expiation is upon you, and the blood money is upon you, unless the heirs of your father forgive the blood money. And the expiation is upon you, which is freeing a believing slave. If you cannot do that, then it is obligatory for you to fast two consecutive months, as is the text of the Book of Allah (Mighty and Majestic). We ask Allah for you assistance, success, and what clears the conscience.
And you, my brother, must hold yourself accountable and reflect on the reality. If it is your strong belief that you were negligent and at fault in this driving, or in the tire that struck because you were negligent in not replacing it while it was defective, then expiate by fasting two consecutive months and pay the blood money, unless the heirs of your father forgive you. And if you know that you were not negligent, and the driving was moderate, and the tires were sound, then nothing is upon you, and praise be to Allah for the decree of Allah. Yes.
