Q: I traveled on Thursday, corresponding to 17 Muharram 1416 AH, with one of my sons who was fifteen years old, and Allah decreed upon us an accident caused by the detachment of one of the rear tires, which led to the car leaving its path and colliding with a rock on the side of the road, resulting in the death of my son . The truth, O honorable scholar, is that I was driving at a very high speed, and I knew that the detached tire had a slight detachment, but I had traveled with it in that condition more than once. My question, O honorable scholar, is summarized as follows: First: What is the expiation incumbent upon me? Since I caused the death of my son. Second: Did the Hajj of Islam become obligatory upon him, and how is it performed on his behalf?
A: If the matter is as you mentioned, then you owe the expiation for accidental killing; because your negligence was the cause of the accident, and the expiation is: freeing a believing slave, and if you do not find one, then fasting two consecutive months. As for Hajj, Hajj is not obligatory upon your son unless he had wealth
with which he could perform Hajj before his death, in which case he performs Hajj on his behalf from his wealth, and if he did not have wealth, then Hajj is not obligatory upon him, and if someone performs Hajj on his behalf voluntarily, there is no harm. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
