Q: I submit this letter to your eminence, in which I ask your eminence to answer what is contained therein, may Allah reward you. First: I inform your eminence that I traveled with my father on a short trip, and at his request, and Allah willed that my father and I overturn in the car at approximately 7:00 PM. My father passed away, and I was saved by the grace of Allah. I was walking sound in body and mind, and the car, along with everything in it, was sound, inspected, and in very good condition. The speed limit was approximately 80 kilometers per hour. Allah willed that we encounter a sail that had fallen on the road from another car, blocking the lane. An oncoming car met me, so I tried to steer around the sail; because it was very large, I feared the oncoming car, so I turned slightly. The rear of the car I was driving mounted the sail lying on the road, and the car overturned twice, to the left and to the right. In that accident, my father passed away, may Allah have mercy on him and on all the deceased of the Muslims. So some people told me
that I was the cause of my father’s death, since I was the one driving the car. I inform your eminence that I fasted immediately, and I am still fasting, and it is the two months that are obligatory; therefore, please inform me about that, may Allah reward you with the best reward. Is there anything remaining for me to do other than fasting, or is fasting sufficient? I am confused about this matter, and the complaint is to Allah, Lord of the Worlds. This is, and may Allah preserve you and reward you with the best reward.
A: It is obligatory for you to pay the expiation for accidental killing because you caused the death of your father. The expiation is freeing a believing slave; if you do not find one, then fast for two consecutive months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
