This is a message received by the program from the questioner Abu Bakr Muhammad, of Sudanese nationality, residing in Jeddah. He says: I have a daughter who is eight years old. Since she was young, I gave her to my mother, and I am in Madinah, while my mother lives among the Bedouins outside Madinah. My mother has no son or daughter other than me, so I gave her this daughter to help her with the housework and work outside the house, such as the market and the shop, and so on. Is it permissible for me to take her from my mother to keep her confined to the house and leave my mother? Also, so that we can teach her matters of religion. As I mentioned before, I gave her to be a daughter for her to raise until she grows up and marries her. Now I am hesitating. Please advise us, may Allah reward you.
Answer: If it is possible to teach her and guide her to good while she is with her mother, then leave her with her mother; because dutifulness to her is obligatory, and this is part of that dutifulness. However, if her remaining with her mother keeps her ignorant and she does not receive any education, then this harms her. In that case, you should take her by speaking kindly to her mother and seeking her permission, so that you can teach her what benefits her and protect her from causes of danger. Likewise, if her remaining with her mother exposes her to danger, or exposes her to foolish people or those with bad intentions, then take her and protect her from danger. Seek for your mother someone to help her, such as a maid other than the daughter, a maid who serves her and helps her with her affairs in her house. As for leaving the daughter with her as a maid, neglecting her education and guidance, and exposing her to causes of fitnah (trial, discord or temptation), that is not permissible. But when taking her from her mother, do what is required of kind words, gentleness, and good manner, so as not to upset the mother and so that there is no severance or undutifulness between you and her.
