The Ruling on the Divorce of an Angry Man

Machine translationRead the Arabic original
The brothers who asked in their letter add: What is the ruling in Islam regarding a man who swears an oath of divorce while angry? And is it a condition that his wife hears the oath of divorce with her own ear, or not? Please inform us; may Allah reward you.
Answer: The matter differs. If the anger is severe, resembling that of a madman, such that he does not understand what he is saying, then his divorce does not take place according to all scholars; it is not effective due to the loss of his intellect.
The second case: His anger is severe, having taken possession of his feelings and controlled his self and heart, and he is unable to escape the intensity of the anger due to an insult between him and his wife, or between him and her father, an insult or a fight that caused the intensity of the anger. The correct view is that it does not take place.
However, if his anger is ordinary, then it takes place. This is the correct view in the issue of anger with this detail, as clarified by Ibn al-Qayyim (may Allah have mercy on him) in his book *Zad al-Ma'ad* and others, and as also clarified by Abu al-Abbas Ibn Taymiyyah (may Allah have mercy on both of them). Yes.
