His first question says: My wife insists on working as an employee in one of the institutions. I know that the workplace itself does not have free mixing of men and women, but the road to it is not free from free mixing. What is the ruling if I prevent her? And what is the ruling on her work if she does not need this work at all, and she is not in material need of it, and she goes to the trouble of going and returning, knowing that she is modest? And what is upon me from the Sharia'ah perspective if I allow her? And do I have the right to prevent her?
Answer: If her workplace does not have free mixing of men and women, and it is a place for women only, and there is no danger to her from the aspect of her honor, then there is nothing wrong with her working. And you must take her to the workplace in a proper manner if there is danger on the road; you must take her there in a proper manner. You may prevent her from that if you see that there is hardship for you or for her, or danger for you or for her. You may prevent her, except if she made this a condition upon you in the marriage contract, and that she remains in her work as a condition between you and her. If there is a condition in the marriage contract that you keep her in the aforementioned work, then Muslims are bound by their conditions. The Prophet (peace and blessings be upon him) said:Jami` at-Tirmidhi 1127Sahih (Darussalam). But you must ensure that in taking her, or that one of her older children or her brothers takes her, so that she reaches the workplace safely and in a proper manner, as long as the workplace does not have free mixing and does not have danger, then there is no blame in that, if Allah wills. Yes.
