This is a letter that reached us from the sender: Mustafa Abdul Qadir from Algeria, residing in Libya. He says in his letter: What is the ruling on a woman who aborts her pregnancy, and the fetus is two months old? And is it permissible to divide the estate before the fetus is delivered? Please inform us, may Allah reward you.
The answer: Abortion has many harms and is not advisable. The correct view among the scholars' opinions on it is that it is not permissible. This is before the formation of the fetus. Once it is formed and the soul is breathed into it, it becomes forbidden and constitutes killing. However, before the soul is breathed into it, before the four months, it is not permissible because of the aggression against a self whose causes have already come together, and also because of the aggression against the multiplication of offspring, which is the thing that Allah (Blessed and Exalted is He) loves and has prescribed for His servants, namely the multiplication of offspring. This procedure eliminates it, reduces it, and cuts it off. Therefore, abortion in this case is not permissible.
May Allah except the first forty days. Some scholars have permitted it in the first forty days as long as it is a drop of sperm. If there is a need for it, there is no harm, but leaving it alone is better.
As for after the forty days, it is forbidden. And after the soul is breathed into it, it becomes killing. We ask Allah for safety. Yes.
