The ruling on the guardian appointing a representative to marry off his ward
Machine translationRead the Arabic original
This is a message from Sudan, from the village of al-Shanah, from the questioner Abdul Qadir Fadl Muhammad Zayn. He asks: Is it permissible for the guardian to appoint a representative to marry off his ward if he is present, such as in the case of a maternal uncle?
Answer: There is nothing wrong with it. The one who represents him, such as the woman’s father, may appoint her maternal uncle, or appoint one of his mature sons to represent him in the marriage. There is nothing wrong with the guardian appointing a representative to marry off his daughter, or his sister, or his brother’s daughter. He may appoint someone who is qualified for the marriage, if he is a mature person, such as her mature maternal uncle, or her brother, or her mature paternal uncle. There is nothing wrong with it.
Likewise, the groom has the right to appoint a representative. The groom himself may appoint someone to accept the marriage contract on his behalf. He may appoint his father or his brother to accept the marriage of so-and-so, saying: “I accept this marriage for my brother so-and-so, or for my paternal uncle, or for my brother’s son, or for my son.” There is nothing wrong with it. Therefore, agency is permissible for both the guardian and the groom himself.
The presenter: With his presence, meaning.
The Shaykh: With his presence and his absence.
The presenter: May Allah reward you with good.
