Ruling on digging up a grave after burial on the claim that the deceased was taken by the jinn

Machine translationRead the Arabic original
The first message in this episode is from one of our brother listeners. The presenter reads it: (.. M. J. Abu Ali): He has a case in which he says: I do not know my father or my mother, as they passed away at an early age, and it was only my maternal aunt, my mother’s sister, who raised us until we reached the age of relying on Allah and then on ourselves. Since we were three brothers, my eldest brother passed away. When he died, it was in the past, in a time of ignorance and superstition. People told my aunt that my brother’s death was unnatural and that the jinn had taken him. Suspicions fell on my aunt. After three days of mourning, we went and opened the grave to verify, and we found the deceased inside the grave, then we restored it as it was. Is there anything wrong with our action? Please guide us, and if there is an expiation due from us, may Allah reward you with good?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah, upon his family and his Companions, and upon those who follow his guidance.
As for what follows:
It is obligatory for the believer to be cautious of the whispers of Shaytan and of obeying the callers of Shaytan. When a Muslim is buried, his grave should not be dug up to see what happened to him or what befell him. Rather, one should supplicate for him with forgiveness and mercy if he was a Muslim. There is no need to inspect the grave on the claim that the jinn took him, or on the claim that this or that happened. All of this is not permissible, because one might inspect the grave and see things that cause sadness from uncovering the grave, such as seeing that he is being punished. Therefore, the grave should not be revisited except for a necessity that must be met, such as if the buriers forgot an important item, like a digging tool or something similar. It is permissible to dig it up to retrieve their need. However, for the whispers of Shaytan and the claims of the ignorant, it is not permissible. Rather, one should supplicate for him with forgiveness and mercy, and not dig up his grave again because so-and-so said the jinn took him, or because we want to see if he is being punished or granted mercy. All of this is not correct and is not permissible.
The presenter: May Allah reward you with good and do you good. Is there an expiation due from them? Is there any guidance?
The Shaykh: There is no expiation due from them. They must seek forgiveness and repent, and praise be to Allah. There is no expiation due from them.
The presenter: May Allah reward you, may Allah reward you with good.
