The ruling on remaining with a husband who does not pray due to urinary incontinence

Machine translationRead the Arabic original
Question:
The questioner, Umm Muhammad, from Riyadh, in her final question says: My husband suffers from urinary incontinence, and I know the ruling on ablution and the ruling on prayer in the Shari'ah, but he leaves off prayer because of Satan's whispers to him after his purification. I have struggled hard in this matter, and he does not pray except on Friday. He is keen on prayer, and on my prayer and the children's prayer.
The question is: What is the ruling on my remaining with him, Your Eminence, Shaykh Abdulaziz?

Answer:
It is not permissible to remain with him. Leaving off prayer is disbelief, we seek refuge in Allah. It is obligatory for him to pray despite the incontinence. He performs ablution for every prayer, praise be to Allah, and prays with the people. Even if urine comes out of him, he is excused. When the mu'adhdhin calls to prayer, he performs ablution and prays with the people, praise be to Allah. It is not permissible to leave off prayer because of incontinence, just as the woman with irregular non-menstrual bleeding who has constant blood. She prays, performs ablution for every prayer, and prays as the Prophet (peace and blessings be upon him) commanded her to do.
As for remaining with a person who does not pray except on Friday, that is misguidance and disbelief. We ask Allah for safety. It is not permissible. The Prophet (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
We ask Allah for safety. Yes.

The presenter: May Allah reward you with good.
