Question:
The sender, Salem Jabbar al-Muhajili, from Khamis Mushait, sent this message, saying in it: Is it permissible for a man to marry with his daughter's mahr, whether he is rich or poor?

Answer:
There is no blame on him; because the child is from his earnings, and the Prophet (peace and blessings be upon him) said:
The best of your provision is what you earn, and your children are part of what you earn.إن أطيب ما أكلتم من كسبكم، وإن أولادكم من كسبكم
Sunan Ibn Majah 2290Sahih (Darussalam)
And he said to another who said to him: "O Messenger of Allah, my father has seized my wealth." He said:
You and your wealth belong to your fatherأنت ومالك لأبيك
So there is no blame on a man to marry from his daughter's wealth, or from his daughter's mahr; there is no blame on him in that if his daughter does not need this thing. As for if she needs it, then he starts with her, giving her her need for her husband, from what women adorn themselves with; he gives her her need from her mahr, and there is nothing wrong with him taking the rest. And if she permits him to take all of it, and she is of sound mind, then there is nothing wrong with that. But if she is not of sound mind, or does not permit it, then he gives her her need, and does not take what harms her, and there is nothing wrong with him taking the surplus.
