The ruling on marrying a woman without giving her a mahr
Machine translationRead the Arabic original
The first message in this episode is one that reached the program from the Arab Republic of Egypt, sent by one of the brother listeners from there, who indicated his name with the letters (A. A. A. A). Our brother has a collection of questions, one of which says:
I married a girl and did not pay her any mahr in the form of money or gold, and this was with the consent of both parties, even though I was able to do so, as I furnished the marital home. Have I deprived her of her right? And if so, can I now return some of it to her or to her family? May Allah reward you with good.
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah, upon his family and his Companions, and upon those who follow his guidance.
As for what follows:
It is obligatory to give the wife something of money, even if it is a little, if she is satisfied with that, whether it is cash or goods such as clothing or jewelry of gold and silver, and this is sufficient. If you did not give her anything at all, then you give her the mahr al-mithl, the mahr that is given to her equals, unless she forgives you. If she forgives you, then there is no blame on you, and praise be to Allah.
And Allah (Exalted and Majestic is He) said: [Surat al-Nisa: 24] The husband gives some money and agrees with the wife on some money, or with her wali, or gives them what is easy, and if they are satisfied with that, it is sufficient. If you gave her something of money that is not cash, such as jewelry or clothing, or furnished the home for her, this money is a gift to her, and this furniture becomes her property, so it serves as her mahr, and there is no blame in that, and praise be to Allah. But if you did not give her anything at all, and she forgave you and waived the mahr, then there is no blame. And if she asks for something, give her what satisfies her, and praise be to Allah. Yes.
