The ruling on one who believes he caused the death of a sick man
Machine translationRead the Arabic original
Question:
From Yemen, the questioner (Abdullah A.) says in this question: Your Eminence, peace be upon you and Allah’s mercy and blessings. He says: A sick man asked a man to buy him a syringe for shortness of breath from the pharmacy, because he was accustomed to buying it from there before. So the man went and bought it for him. The sick man then ordered him to inject it, so he injected it into the muscle. This syringe is meant to be injected into the vein, but he injected it into the muscle in the evening. In the morning, the sick man died.
Now, the man who gave him this injection cannot sleep at night because of the horror of what happened to him. He believes that he is the one who killed him with that injection he gave him, even though they went to doctors with a similar injection and asked them about it: Does it kill if injected into the muscle instead of the vein due to the man’s ignorance? They told them: No. But it may cause some inflammation after being injected. Despite this, the man was not convinced; rather, he says that he is the one who killed him.
We ask you to clarify this for us, may Allah reward you.
Answer:
The one who did it should ask the specialized doctors. If they say that his action caused the death, he owes the expiation for accidental killing, which is freeing a slave. If he is unable to do so, he must fast two consecutive months. If they say that it does not cause death, then he owes nothing, and praise be to Allah.
The presenter: May Allah reward you.
