Question:
Our brother says: Some scholars issue a fatwa that if a woman leaves off the hijab, it is not forbidden by the consensus of the scholars, citing a hadith of the Prophet (peace and blessings be upon him) which means: "When a woman reaches puberty, it is not permissible for anything of her to be seen except her face and her two hands"? May Allah reward you, and peace be upon you and the mercy of Allah and His blessings.

Answer:
This statement is incorrect. A woman is required to wear the hijab; as Allah (Glorified and Exalted is He) said in His Noble Book in Surat al-Ahzab:
And when you ask [his wives] for something, ask them from behind a partition. That is purer for your hearts and their hearts.وَإِذَا سَأَلْتُمُوهُنَّ مَتَاعًا فَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ
[al-Ahzab:53] He, the Exalted, made it clear that the hijab is obligatory, and He did not say: except for the face or the hands. Rather, He stated
So ask them from behind a screenفَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ
[al-Ahzab:53] a wall or a khimar, or a jilbab with which she covers herself, meaning a hijab that achieves the intended purpose so that her adornment is not seen. So praise be to Allah.
Then He (Glorified and Exalted is He) made it clear that this is purer for the hearts of everyone. He mentioned the cause, saying:
That is purer for your hearts and their heartsذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ
[al-Ahzab:53], meaning: purer from inclining toward immorality and falling into immorality, and safer for everyone; because the exposure of the woman is one of the causes of fitnah (trial, discord or temptation). So if she wears the hijab, this is one of the causes of the safety of the hearts. For this reason, in the other verse in Surat al-Nur, He (Glorified and Exalted is He) says:
except to their husbands, their fathers, their husbands' fathers, their sons, their husbands' sons, their brothers, their brothers' sons, their sisters' sonsوَلا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ ..
[al-Nur:31], the verse.
As for the hadith mentioned by the questioner, it is a weak hadith that is not authentic from the Prophet (peace and blessings be upon him). It is what is narrated from Aisha (may Allah be pleased with her) that her sister Asma, the daughter of Abu Bakr al-Siddiq (may Allah be pleased with him), both entered upon the Prophet (peace and blessings be upon him) wearing thin clothes, so the Prophet (peace and blessings be upon him) turned away from her and said: O Asma:
When a woman reaches the age of menstruation, it is not permissible for anyone to see of her except this and this.إن المرأة إذا بلغت المحيض لم يصلح أن يرى منها إلا هذا وهذا
Sunan al-Bayhaqi 10:890
and he pointed to his face and his two hands.
Some people argued with this that a non-mahram woman has the right to uncover her face and her two hands in the presence of a non-mahram, such as her husband's brother, her sister's husband, her paternal cousin, and others among people. This is wrong, and the hadith is weak and not authentic from the Prophet (peace and blessings be upon him); because it has many defects:
One of them is that it is disconnected; because it is from the narration of Khalid ibn Daryak from Aisha, and he did not hear from her.
The second is that Sa'id ibn Bashir is in its chain, and he is weak and his narration is not used as evidence.
The third is: the third defect is that it is from the narration of Qatadah from Khalid ibn Daryak, and he is a tadlis (concealment of a defect in a chain) practitioner with the 'an (from) notation.
The fourth defect is that this is denounced in its text; because it is not fitting for Asma, who is the righteous woman, the wife of al-Zubayr, a woman known for goodness and uprightness; it is not fitting for her to enter upon the Prophet (peace and blessings be upon him) in thin clothes. This is a denounced text, anomalous, contradicting the authentic hadiths and the verses.
Fifth: It is possible that this was before the revelation of the verse of the hijab, that this was when it was permissible for the woman to uncover, then the hijab was revealed, and the women were ordered to cover themselves.
So these are five defects in this hadith. It contradicts the text of the noble verse,
And when you ask [his wives] for something, ask them from behind a partition. That is purer for your hearts and their hearts.وَإِذَا سَأَلْتُمُوهُنَّ مَتَاعًا فَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ
[al-Ahzab:53], along with the defects in it, and along with the contradiction to the saying of Allah the Exalted:
not expose their adornment except to their husbandsوَلا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ..
[al-Nur:31], the verse. The face is part of the adornment, and the two hands are part of the adornment. We ask Allah for guidance and success for everyone. Yes.
