Question:
Our brother also asks and says: Many people build over graves with bricks, and the construction is not high, but rather its height is two or three shibr. Is this construction forbidden?

Answer:
Yes, yes. The Messenger (peace and blessings be upon him) forbade building over graves, and forbade making them into mosques; because it is a means to exaggeration in them, shirk (associating partners with Allah), and magnifying them. So it is not permissible for a Muslim to build over graves, neither a mosque nor anything else. It is established from the Messenger of Allah (peace and blessings be upon him) that he said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
Narrated by the two Shaykhs, al-Bukhari and Muslim, in the two Sahihs.
And Muslim narrated in his Sahih from Jundub ibn 'Abd Allah al-Bajali (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that he said:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد؛ فإني أنهاكم عن ذلك

Narrated by Muslim in the Sahih.
So the Messenger (peace and blessings be upon him) forbade making graves into mosques, and informed that this was the practice of the past peoples whom Allah condemned and criticized. He informed that he forbade this (peace and blessings be upon him). And shirk has occurred among people because of these buildings and these mosques; for this reason he cursed (peace and blessings be upon him) those who made them; because they are a means to shirk and the worship of the created beings other than Allah.
And in the Sahih from Jabir ibn 'Abd Allah al-Ansari (may Allah be pleased with him) and from his father, he said:
Allah's Messenger (ﷺ) forbade that the graves should be plastered or they be used as sitting places (for the people), or a building should be built over them.نهى رسول الله ﷺ أن يجصص القبر، وأن يقعد عليه، وأن يبنى عليه

So Jabir (may Allah be pleased with him) informed that the Messenger (peace and blessings be upon him) forbade plastering graves, sitting on them, and building over them. And this is explicit in the prohibition of that.
So building over a grave is forbidden, and so is sitting on it, and so is plastering it; because it is a means to exaggeration in it, then to its worship other than Allah. And there is no power and no strength except with Allah, as happened to the Jews and the Christians, and as happened to the extremists of this Ummah (Muslim community) who built over graves and magnified them until they were worshipped other than Allah, and until they became deities worshipped alongside Allah. As has happened at the grave of al-Husayn ibn 'Ali (may Allah be pleased with him) in Egypt, and at the grave of al-Badawi, and at the grave of al-Jilani in Iraq, and at many graves.
Until some of the ignorant people did it at the grave of the Prophet (peace and blessings be upon him) in al-Madinah due to their ignorance. When they saw that it was built over, and that there was a dome over it, they thought that this would cause them to be called upon in supplication. The Messenger (peace and blessings be upon him) was only buried in his chamber in the house of 'A'ishah; it was not built over. He was only buried in the house of 'A'ishah in her chamber (may Allah be pleased with her) out of fear that people would exaggerate in him if he were placed in al-Baqi' exposed to the people. So he was buried in her house (may Allah be pleased with her and make her satisfied). Then some of the later princes in al-Madinah placed the dome over the chamber before the Saudi state.
So the conclusion is: that building over graves is not permissible, and it is one of the means to shirk, whether the building is a mosque or not a mosque, or a dome built over it. All of that is not permissible. And it is obligatory that the graves be open and exposed in the cemeteries, as was the case in his time (peace and blessings be upon him) in al-Baqi' and other than al-Baqi'.
