The ruling on a man who discovers that his wife is not a virgin after consummating the marriage

Machine translationRead the Arabic original
Question:
If a man marries a girl, and after consummating the marriage he finds that she is not a virgin, what should he do?

Answer:
This has causes; the virginity may have been lost for reasons other than fornication. If her outward appearance is one of goodness and uprightness, he must have a good opinion of her in this matter. Or, if she committed a heinous act and then repented, expressed remorse, and goodness became apparent in her, that does not harm him. The virginity may also have been lost due to severe menstruation, for the scholars have stated that a severe menstrual flow can remove the hymen.
Likewise, the hymen can be removed by certain jumps, if she jumped from one place to another, or leaped from one place to another, or descended from a high place to a low place with force. The loss of the hymen does not necessarily mean it was lost through fornication. No. If she claims that her virginity was lost by something other than a heinous act, there is no blame on him. Or if it was due to a heinous act, but she was coerced and forced, then this also does not harm him, provided that a menstrual cycle has passed since the incident, or if she mentions that she repented and expressed remorse, and that what she did was during a time of her folly and ignorance, and then she repented and expressed remorse; then it does not harm. It is not permissible to spread this; rather, he should cover it up. If he is convinced of her truthfulness and uprightness, he should keep her. Otherwise, he should divorce her while covering it up and not revealing what would cause fitnah (trial, discord or temptation) and evil.

Question: ..?

Answer: No, it is not obligatory unless he knows that she committed a heinous act; because the hymen may be lost due to menstruation, or it may be lost due to other causes. She may have been coerced, and the coerced person has the ruling of one who did nothing. She may also have... done it with consent, but Allah accepted her repentance, and her condition improved.

Question: In some countries, they like to see the blood of the hymen on the cloth. If a man finds that his wife is not a virgin in it, and he wants to cover that up, so he spoke to her about it and released her, are they allowed to return his money?

Answer: If it is necessary, he can do this with something else, with other blood to cover for her. After that, he is given the choice; if he wishes, he keeps her, and if he wishes, he divorces her. He can use blood from other than the hymen if it is necessary; because they must show something according to their customs. If he does not do so, they will accuse her of fornication. He can place something from other blood, from the perspective of covering for people. The Prophet (peace and blessings be upon him) said:
Whoever covers (the sin of) a Muslim, Allah will cover him (his sin) in this world and in the Hereafter.من ستر مسلمًا؛ ستره الله في الدنيا، والآخرة
