Our brother raised two questions in a previous episode, and in this episode he asks and says: What is the ruling on a man who contracted a marriage for his son without an agency from the son and without his permission, knowing that the son is twenty years old? Also, the son was present during the contract. Is the contract valid, or is it invalid according to the Shari'ah? Please inform us, and may you have abundant thanks?
The answer: It is not permissible for the father, nor for anyone other than the father, to contract a marriage for his son, his brother, or anyone else, except with his permission or through an agency, if he has reached puberty. And this, as mentioned in the question, has reached twenty years of age. So his father has no right to marry him off except with his permission. If the son did not give him permission for that, the marriage is not valid, and it is obligatory to renew it; because the husband is the one who owns the contract, so if he did not perform it directly and did not appoint an agent, there is no contract.
