This is a message received by the program from the listener, the pilgrim Abdul-Rahman Saleh Muhammad Ahmad, from the Republic of Somalia. In his first question, he says: Is staying overnight in Mina obligatory for the pilgrim? I have read a hadith from Ibn Abbas that says:
When you have stoned the pillar, stay overnight where you wishإذا رميت الجمرة فبت حيث شئت
So I ask you, may Allah reward you with the best reward, to clarify this issue for us.
Answer: There is scholarly disagreement regarding staying overnight in Mina. Some scholars said that it is obligatory, and this is the stronger and more correct position. This is because the Prophet (peace and blessings be upon him) stayed overnight in Mina and said:
Take your rituals from meخذوا عني مناسككم
He granted a dispensation to al-Abbas and the shepherds to leave off staying overnight. Al-Abbas was granted this for the sake of providing water, and the shepherds for the sake of grazing their animals at night. When a dispensation was granted to them and not to others, it indicates that it is obligatory for others. This is the stronger position. Some scholars held that it is not obligatory; this is narrated from Ibn Abbas, but there is doubt regarding its authenticity from Ibn Abbas. Therefore, the best, stronger, and closest to the truth is that staying overnight in Mina is obligatory for pilgrims on the eleventh and twelfth nights for those who hasten to leave. As for one who does not hasten and remains until the thirteenth day, he stays overnight on the thirteenth night. This is what the Messenger (peace and blessings be upon him) did, and he is the role model (peace and blessings be upon him). He said in the authentic hadith:
Take your rituals from meخذوا عني مناسككم
meaning: Learn from me and follow me in the acts of Hajj (peace and blessings be upon him). However, if one has an excuse, such as the shepherds who need to graze their camels outside Mina, or if he is among those providing water to the pilgrims at Zamzam or elsewhere, or if he has a legal excuse such as an illness that requires transferring him to a hospital and it is not feasible for him to remain in Mina, or similar excuses that justify leaving off staying overnight, then there is no blame on him. Otherwise, if one is healthy and has no excuse, he stays overnight in Mina following the example of the Messenger of Allah (peace and blessings be upon him) and as a precaution for his religion. Yes.
