Question:
One of the brothers asks about the ruling on staying overnight in Mina on the nights of the days of Tashriq, and what is your opinion, also, about many pilgrims remaining outside of Mina during the day of the days of Tashriq in this time, without returning to it except at night?

Answer:
Staying overnight in Mina is obligatory, according to the most correct of the two opinions, for whoever is able to do so, except for one who has an excuse, as the Prophet (peace and blessings be upon him) told al-Abbas when he sought permission to stay overnight in Mina; he gave him permission to stay overnight in Makkah for the sake of the water distribution, and he gave permission to the shepherds for the sake of herding. This indicates that the one who has no excuse remains in Mina and stays overnight. As for the one who has an excuse, such as a shepherd who herds camels—for they used to perform Hajj on camels—or a sick person who is transported to a doctor and cannot stay in Mina, or a doctor who has work at night that requires him to be transported, or who waters the pilgrims; there is no harm.
As for the one who has no excuse, he stays overnight in Mina if he secures a place in Mina, and the obligatory part is most of the night. So if he stays until the end of the night and leaves at the end of the night, there is no harm. Or if he sits outside of Mina at the beginning of the night, then comes to Mina at night, the result is that he stays overnight in Mina for the whole night or most of it.
As for the day, the matter is more lenient in it. If he goes down during the day to his house or to another place, there is no blame on him. But his presence in Mina is also better, even during the day, as the Prophet (peace and blessings be upon him) and his Companions remained in it. Being in it—in Mina—even during the day is better. As for the night, staying overnight is obligatory. And so it is in Muzdalifah; staying overnight in Muzdalifah is obligatory until the last half of the night, and whoever comes in the last half, that suffices before the dawn breaks.
