The Ruling on Combining and Shortening Prayers for the People of Makkah at 'Arafah and Mina

This is a message received by the program from the brother: Hasan al-Andunsi, a resident of the Noble Makkah, in which he says: Is it permissible for the people of Makkah to shorten the prayer during Hajj on the Day of 'Arafah and the days of Mina? Please inform us, may Allah reward you.
Answer: The scholars, may Allah have mercy on them, differed on this. Some said that the people of Makkah complete the prayers, because they are close to 'Arafah, Mina, and Muzdalifah. Others said that rather, they shorten the prayers with the people, because the Messenger (peace and blessings be upon him) approved of them doing so during the Farewell Pilgrimage, and did not order them to complete the prayers. This is a legislation from him (peace and blessings be upon him), because his approval is a proof, just as his command, prohibition, speech, and action are proofs (peace and blessings be upon him). This is the most apparent and closest position, and Allah knows best, that they shorten the prayers with the people and combine them with the people at 'Arafah and Muzdalifah, because the Messenger (peace and blessings be upon him) approved of them doing so, and did not order them to complete the prayers, nor did he prohibit them from combining them. Some of the people of knowledge said that this is for the sake of the rites of Hajj, and some of them said that it is for the sake of travel, because the distance between Makkah and 'Arafah is considered travel by some of the people of knowledge.
In any case, whether we call it travel or say it is for the sake of the rites of Hajj, the Sunnah for them is to shorten the prayers with the people and to combine them with the people; this is the best for them, taking the apparent dispensation, because if this had been prohibited, the Prophet (peace and blessings be upon him) would have clarified it and said to them: "Complete the prayers, O people of Makkah, do not combine them."
It is well known that delaying clarification from the time of need is not permissible according to the people of knowledge, and he (peace and blessings be upon him) was sent by Allah as a clarifier, a guide, and a leader (peace and blessings be upon him). So if the people of Makkah had been prohibited from shortening the prayers, prohibited from combining them, he would have clarified that to them and guided them to it during the Farewell Pilgrimage (peace and blessings be upon him). Yes.
