The ruling on a wife stipulating residence in a specific country

Machine translationRead the Arabic original
Question:
I proposed to a woman, and she asked me for a condition that she not leave this country. How is that possible if I have children from her in the future? Will she be in one country and I in another?

Answer:
Muslims are bound by their conditions. If the awliya (guardians) of the woman stipulate a specific place for him and he commits to it, he must remain in that country until they are satisfied with his leaving it. If they stipulate that he and his wife be in Riyadh, or in al-Madinah, or in Makkah, or in al-Ta'if, and he commits to that, or in Cairo, or in Damascus, or in any place, and he commits to that, he must fulfill the condition, except in the case of a compelling matter that overpowers them both; out of fear for their religion; out of fear for their lives. This is a valid legal excuse.
As for being lenient with the conditions, that is not permissible. The Muslims are bound by their conditions, and 'Umar (may Allah be pleased with him) said: "Cutting off rights is at the conditions." A believer should fulfill the conditions, not rush, not violate this condition, and not be like the hypocrites who do not care. Rather, he should adhere to the conditions and stand by them, except in a case of dire necessity where they have no choice.
