Question:
He proposed to the girl from her family, and said: he would show her the apartment, and she went with him. The day she went with him, he said: "That's it, they are going to contract the marriage for us in two days, let us enter now." They entered, and immediately after they entered, Allah willed that she would menstruate right after this intercourse. There was no pregnancy, and nothing happened to her. Then they performed the legal marriage contract. What is the ruling in this case?

The Shaykh:
Did he commit unlawful sexual intercourse with her before?

The student: Yes.

Answer: This is abominable, I seek refuge in Allah. He has no right to marry her except after repentance, after she repents to Allah, and he also repents.
Do they perform the legal marriage contract with her?

Answer: After repentance, if she regrets, and shows her regret, and ceases... if they both repent and return to Allah; they may be married. Before this, they may not be married.

The student: Should I write this for them?

Answer: Inform them, yes.
