Question:
A man has a daughter who is two years old, and he is always away from home. So he contracted his daughter to one of the neighbors so that this man would be a mahram (a relative one may not marry) to his wife, and this man would act on behalf of the man in what is required during the man's absence. Is this permissible? Knowing that the man divorced her immediately after the contract?

Answer:
In any case, it is permissible, as long as she is under nine, it is permissible to contract her marriage for the sake of benefit if he sees a legitimate benefit in it, just as al-Ṣiddiq (may Allah be pleased with him) married his daughter A'ishah to the Prophet (peace and blessings be upon him) when she was six or seven years old. This is an exception.
As for when she reaches nine, he has no right to marry her off except with her permission, or if she is older than nine, her permission is necessary. As for one under nine, if he sees the benefit, and it is not for the sake of money, but for the sake of legitimate benefit, such as a good person, and he wants to secure him, and obligates him before the opportunity is lost, and his intention is the well-being of his daughter; there is no blame on him if she is under nine.
