Q2: What is the ruling on a man who proposes to a girl aged between two and ten years old, or less, and concludes the marriage contract? Is his marriage valid or not? It is known that when she grows up, she may not want him. What is the age of a girl at which it is permissible to propose to her?
A2: It is permissible to contract the marriage of a young girl with her father, especially if he sees benefit for her in doing so; due to the story of the Prophet (peace and blessings be upon him) marrying 'A'ishah when she was under nine years old. As for anyone other than the father, he has no right to marry off a girl under nine years old under any circumstances, nor a girl who has reached nine years of age or older without her permission, based on the saying of the Prophet (peace and blessings be upon him):
A woman without a husband (or divorced or a widow) must not be married until she is consulted, and a virgin must not be married until her permission is sought. They asked the Prophet of Allah (ﷺ): How her (virgin's) consent can be solicited? He (the Holy Prophet) said: That she keeps silence.لا تنكح الأيم حتى تستأمر، ولا تنكح البكر حتى تستأذن، قالوا: يا رسول الله: وكيف إذنها؟ قال: أن تسكت
