Q1: My colleague tasked me with the following: He says: In Ramadan of last year, 1418 AH, it happened that I had intercourse with my wife shortly before the Fajr adhan, and I did not finish until after I heard the first adhan , meaning: from a mosque in another alley, which I heard while I was still continuing, and the second called from another mosque, and the third called from another mosque, but the problem is that I was confused about which of the mu'adhdhins I heard was truthful, knowing that the mu'adhdhins are not on the same time, so what is the ruling for me?
A1: Whoever has intercourse before the dawn breaks in the month of Ramadan, then continues the intercourse after the second dawn breaks, and he is one upon whom fasting Ramadan is obligatory, then he must make up the fast for that day on which the intercourse occurred, and he must pay the expiation for intercourse. What appears from the condition of this person is laxity in the matter of fasting, where he continued the intercourse after hearing the mu'adhdhin calling for the entry of the time of the second dawn, and the criterion is the entry of the time of the second dawn, and there is no criterion for one who delays the adhan after it. It was obligatory for this person to withdraw immediately from the moment he heard the first mu'adhdhin calling for the entry of the second dawn, and since he continued the intercourse after hearing the adhan, this person is required to pay the expiation for intercourse during the day of Ramadan; because the intercourse occurred in the first part of it. The expiation is freeing a believing slave, if he does not find one or is unable to do so, then he fasts two consecutive months, if he
is unable due to illness or old age, then he feeds sixty poor people, for each poor person half a sa' (a dry measure of about 3 kg), and its amount by weight is: one and a half kilograms of wheat or rice or other staple food of the country. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
