Q: An incident occurred between me and my wife on the dawn of Sunday, corresponding to 29/9/1416 AH, in the blessed month of Ramadan. This was because I had intercourse with my wife in a closed room at 5:17 (17: 5), and the act was completed in a short time, at approximately 5:22 (22: 5) on the dawn of that Sunday, corresponding to 29/9/1416 AH. The time in Makkah al-Mukarramah was 5:31 (31: 5), and the time in the city of al-Qunfudhah was approximately 5:26 (26: 5) on the dawn of that Sunday. When I finished the intercourse, I went out to perform ghusl, and I heard the voice of a mu'adhdhin calling the adhan for the Fajr prayer . After a period of one to two minutes, I heard the voice of the neighborhood mu'adhdhin calling the adhan for the Fajr of that Sunday. O Shaykh, is there a sin upon me for having intercourse with my wife during this period? I inform you that this situation has recurred on my part since the year 1413, and I am now in
confusion about my affair, knowing that my wife refused and was coerced into it, and because she is suffering from a minor illness in her body. Therefore, I ask you, O Shaykh, to issue a fatwa on my matter. As you know, this is the month of Ramadan, a blessed month, and a person wants to complete his fasting. I inform you that I continued fasting, as did my wife, and we did not break our fast until that Sunday ended. May Allah reward you with good.
A: If the reality is as you described, that after the intercourse you heard the mu'adhdhin, and that it was also confirmed to you that a few minutes remained until the dawn appeared after the intercourse, then there is nothing upon you; because the intercourse was outside the time of fasting, and it does not harm you that you did not perform ghusl until after the dawn appeared. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
