Q2: I wish to give charity on behalf of my son; is that permissible or not? And is the Hajj of Islam obligatory upon my son or not, given that he reached the age of eighteen and did not perform Hajj ? And is it permissible for me to name a child after my deceased son if I am blessed with another child?
A2 : Giving charity on behalf of a deceased person is among the righteous deeds prescribed by the Shari'ah, and its reward reaches
the deceased according to the intention of the one giving charity. The evidence from the Sunnah for this is abundant. The Hajj of Islam is obligatory upon your aforementioned son; because he reached the age of puberty, provided he was able to perform Hajj. Therefore, if he left an estate, Hajj should be performed on his behalf from his estate. If a volunteer is found to perform Hajj on his behalf, that is permissible. It is established from the Prophet (peace and blessings be upon him) in the hadith of Ibn 'Abbas - (may Allah be pleased with them both) - who said:
A man came to the Prophet (peace and blessings be upon him) and said: My father died and he had the Hajj of Islam upon him; should I perform Hajj on his behalf? He said: Do you think that if your father had left a debt upon him, you would pay it off on his behalf? He said: Yes. He said: Then perform Hajj on behalf of your father.أتى النبي صلى الله عليه وسلم رجل فقال: إن أبي مات وعليه حجة الإسلام أفأحج عنه؟ قال: أرأيت لو أن أباك ترك دينًا عليه أقضيته عنه؟ قال: نعم، قال: فاحجج عن أبيك
It was narrated by al-Nasa'i and others. There is no harm in naming a child after your deceased son if you are blessed with another child. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
