Abu Layla : In the name of Allah, the Most Gracious, the Most Merciful. A woman wants to perform Hajj on behalf of her son who passed away seven months ago at the age of twenty-seven. She said at his funeral, “If Allah wills, I will perform Hajj on his behalf,” because he had not performed Hajj. She has the ability to do so, and his brothers paid off his debts, but they have not performed the Hajj of Islam. He has a son who is two months old. The woman has already performed the Hajj of Islam and wants to go with a mahram to perform Hajj on behalf of her son. Is this permissible, O Shaykh?
The Shaykh : There is no evidence in the Shari'ah that permits a mother to perform Hajj on behalf of her son. Rather, the correct ruling is the opposite: that the son performs Hajj on behalf of his mother and his father. Therefore, she should perform Hajj for herself as a voluntary act, or on behalf of her father and mother if they have not performed the Hajj of Islam and were excused for not performing it. In that case, she performs Hajj on behalf of her father or her mother. If they have already performed the Hajj of Islam, she performs it on behalf of one of them, starting with her mother as a voluntary act. As for her son for whom she wanted to perform Hajj, if Allah wills, her young son will grow up, be raised with an Islamic upbringing, be consistent in prayer, and then perform Hajj for himself when he is able, and then perform Hajj on behalf of his father. This is what the Shari'ah provides.
Abu Layla : May Allah reward you, our Shaykh.
The Shaykh : And beware of that.
