Hajj on behalf of another without payment

Machine translationRead the Arabic original
Fatwa number ( 18465 )
Q: I entrusted a person to perform the obligatory Hajj on behalf of my mother. Knowing for certain that performing the obligation requires effort and money, I gave the person I entrusted a sum of money so that he could spend from it. However, this person told me that he works for one of the mutawwifin (pilgrimage guides) in serving the pilgrims and does not spend any amounts whatsoever from the time he leaves to perform the obligation until he returns from it. I tried to make him understand that for the Hajj to be accepted, it is necessary to spend money, but he refused. I then convinced him to accept the amount on the basis that it was a gift. He accepted my suggestion after a long discussion, traveled, completed the obligation, and returned safely, by the will of Allah. I was surprised to find that he was returning the amount to me; because he learned while he was at Muzdalifah
that this amount he took as a gift would deprive him of his personal reward from Allah for performing the obligation. He was angry with me because he thought I knew that taking this amount would deprive him of his reward and recompense from Allah; because he took the worldly reward (the amount). This caused me much embarrassment, as I realize that the condition of spending money must be present in Hajj. I want to give him this amount in any form, whether as a gift or as an expression of gratitude and appreciation for his person. I ask your Eminence to inform me of the way to give him this amount without depriving him of his reward from Allah for performing that obligation for my mother?

A: If this person whom you entrusted with Hajj on behalf of your mother has performed the rituals with the intention of acting as her proxy, then his Hajj on her behalf is valid. Both of you have reward in that, and your mother has the reward of Hajj, if Allah wills, whether he took the money you paid him or not. And if he left it out of modesty and for the sake of seeking reward, that is greater for his reward and more likely for the acceptance of his Hajj. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
