A20: Using the miswak during the day in Ramadan is a recommended practice (sunnah); because the miswak is among the confirmed recommended practices in fasting and otherwise.
It is recommended to use the miswak throughout the day, according to the correct opinion. Some scholars hold that the dispensation (rukhsah) for using the miswak is before the sun passes its zenith, while after the zenith one should refrain from using it. A hadith is reported on this matter, but it is not authentic from the Prophet (peace and blessings be upon him). As for what is authentic, it is that one uses the miswak throughout the day, and this does not affect his fast. However, he must not swallow any of the remnants of the miswak, or the debris that the miswak raises from his gums and teeth; he should spit these things out, and this does not affect his fast. He cleans his mouth with the miswak, freshens his mouth with the miswak, and removes the traces of residue in his mouth; so there is nothing wrong with this, rather it is recommended.
