His Eminence the Shaykh has a final question regarding the miswak after 'Asr in Ramadan. What is its ruling?

Answer:
Its ruling is that there is no harm in it. Its ruling is a recommended practice (sunnah) absolutely, at all times. The miswak is for the fasting person and the non-fasting person, in 'Asr and at other times. This is based on his saying (peace and blessings be upon him):
Siwak is a means of purification for the mouth and is pleasing to the Lord.السواك مطهرة للفم مرضاة للرب
Sunan an-Nasa'i 5Sahih (Darussalam)
And he said (peace and blessings be upon him):
Were it not hard on my ummah, I would order them to use the tooth-stick at the time of every prayer.لولا أن أشق على أمتي لأمرتهم بالسواك عند كل صلاة
Sunan Abi Dawud 47Sahih (Al-Albani)
This encompasses the Zuhr and 'Asr prayers and others, for the fasting person and the non-fasting person.
