A342: Using the miswak during the day in Ramadan is a recommended practice (sunnah); because the miswak is a strongly emphasized recommended practice in fasting and otherwise. It is recommended to use the miswak every day, according to the correct opinion. Among the best characteristics of the fasting person is the miswak, as mentioned in the hadith. It is recommended for the fasting person to use the miswak every day. Some scholars hold that the dispensation (rukhsah) regarding the miswak is before the sun passes its zenith (zawal), whereas after the sun passes its zenith, one should refrain from using the miswak. A hadith is reported on this matter, but it is not authentic from the Prophet (peace and blessings be upon him). What is established is that one uses the miswak every day, and this does not affect his fast. However, he must not swallow any of the remnants of the miswak, or the remnants that the miswak raises from his gums and teeth. He should spit out these things, and that does not affect his fast. He cleans his mouth with the miswak, makes his mouth pleasant with the miswak, and removes the traces of waste in his mouth. There is nothing wrong with this; rather, it is recommended.
