Q5: The Maliki school holds that calling Muslims to the 'Aqiqah is permissible regardless of their number, because one of its benefits is strengthening the bonds among Muslims. During this gathering, they collect donations for the newborn and raise their hands to make du'a for him. The Hanbali school holds that gathering for the 'Aqiqah is a bid'ah (religious innovation) and there is no evidence for it; rather, only the witnesses are invited, and there is no donation for it?
A5: The 'Aqiqah is a confirmed sunnah (recommended practice). For a boy, two sheep are slaughtered, and for a girl, one sheep is slaughtered on the seventh day after the child's birth. The head of the male child is shaved and he is given a name, and the female child is given a name. According to some scholars, it is prescribed (mashru') to divide it into three parts: one-third for the household and their guests, one-third to be sent to the neighbors and relatives, and one-third to be given in charity to the poor, similar to the 'Id sacrifice. Some scholars said: The matter regarding the 'Aqiqah is broad: if the family wishes, they may give it in charity; if they wish, they may eat it; if they wish, they may distribute some and eat some; and if they wish, they may invite to it whom they love from among relatives, neighbors, and others. From this, it is known that there is no harm in cooking it at home and inviting people to it without obligating donations for the newborn or obligating the attendees to make du'a for him. Rather, whoever wishes may donate or make du'a, and whoever leaves that off is not obligated to do so. And no one has the right to specify a form of worship that Allah and His Messenger have not specified, and this is the correct view.
