Fatwa number ( 17645 )
Q: We have learned from Islamic books that the postpartum woman, the nursing mother, and the pregnant woman, if they break their fast in the month of Ramadan, must make up the fasts. However, I read the book (Tuhfat al-'Aris) which states: There is no making up of fasts for the postpartum woman, the nursing mother, or the pregnant woman; rather, they are only required to pay a ransom. It cited as evidence the hadith:
The pregnant woman and the nursing mother, if they break their fast, are required to pay a ransom and are not required to make up the fastsالحبلى والمرضع إذا أفطرتا عليهما الفدية ولا قضاء عليهما
Ibn 'Umar and Ibn 'Abbas
, knowing that the author of (Tuhfat al-'Aris) is Mahmud Mahdi al-Istanbuli , page 302.

A: If the matter is as you described, then what is mentioned in the referenced book is incorrect. The postpartum woman must make up the fasts by consensus, and she is not required to feed the poor. The pregnant woman and the nursing mother, if they break their fast out of fear for themselves, must make up the fasts
and are not required to feed the poor. Likewise, if they break their fast out of fear for their children, they must make up the fasts and are not required to feed the poor, except if they delay making up the fasts until another Ramadan without a valid religious excuse. In that case, they must make up the fasts and feed the poor. Making up the fasts is necessary; for Allah the Exalted said:
So whoever sights [the new moon of] the month, let him fast it; and whoever is ill or on a journey - then an equal number of other daysفَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ
[Al-Baqarah 2:185]
, and the pregnant woman and the nursing mother are in the ruling of the sick person if fasting is difficult for them. As for the one who is only required to feed the poor, it is the old man who cannot fast due to his age and the sick person who is not expected to recover, among men and women; because they are unable to make up the fasts; for Allah the Exalted said:
Allah does not charge a soul except [with that within] its capacityلاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَا
[Al-Baqarah 2:286]
, and because it is established from a group of the Companions (may Allah be pleased with them) regarding that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
