The first question of Fatwa No. ( 20930 )
Q1: A woman performed Hajj in the year 1418 AH and entered the state of ihram for 'Umrah, combining it with Hajj (tamattu'). During the tawaf of 'Umrah, she experienced a state of ritual impurity, but she did not inform anyone. After the tawaf, she left, performed wudu', completed the sa'y, and finished her Hajj. During her tawaf for Hajj, she was in a state of ritual purity. What is the ruling on her Hajj, and what is required of her, given that there was no sexual intercourse between the 'Umrah and the Hajj?
A1: This woman erred when she performed tawaf while in a state of ritual impurity, because ritual purity is a condition for tawaf. Therefore, her tawaf is invalid. Consequently, she has not completed her 'Umrah, and her sa'y for 'Umrah is not considered valid, because sa'y is not valid unless it follows a valid tawaf. She must repent to Allah for what occurred. Her Hajj is valid, and she is considered to have performed Hajj in the state of qiran, because she entered the state of ihram for Hajj before performing a valid tawaf for 'Umrah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
