Q: I stoned the large pillar on the Day of Sacrifice, and then I went to the tents in Mina . Then I prayed the midday, afternoon, and sunset prayers. After the sunset prayer, I headed to the Noble Mecca with women and a group to perform the tawaf of ifadah, because I was performing Hajj as a mutamatti'. I did not return from the Noble Mecca due to the women and the severe congestion until after the dawn prayer, as I did not spend the night in Mina on that night, and I was unable to return to Mina due to what I mentioned above. I also did not spend the night in the Noble Mecca on that day; rather, it was between the tawaf and the sa'y until the dawn prayer. Please inform me whether I owe a sacrificial animal or not?
A : If the situation is as you described, that you and those with you descended to Mecca
to perform the tawaf of ifadah and to return to Mina after performing it, and you were unable to return to Mina until after the dawn prayer due to the congestion and the inability to return at night, then you owe nothing for that; because of the generality of the saying of Allah the Exalted:[Al-Baqarah 2:286] and the verses in its meaning. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
