Q183: The questioner says: The imam of the mosque where we pray bequeathed that when he dies, they should bury him in front of the qiblah of the mosque. Is this bequest valid?
A183: This is an invalid bequest; it is not permissible to carry it out. This person must be buried in the cemetery with the people. As for burial in mosques, the Prophet (peace and blessings be upon him) forbade it, cursed whoever did it, and warned his community against it while he was on his deathbed (peace and blessings be upon him). He informed them that it was the practice of the Jews and the Christians. It is also a means to shirk (associating partners with Allah) with Allah (Mighty and Majestic); because establishing mosques at graves and burying the dead in them leads people to believe that the owners of these graves buried in the mosques can benefit or harm, or that they have a special status
to which people seek nearness to Allah (Mighty and Majestic) through acts of worship, other than Allah (Mighty and Majestic). This is the practice of idol worshippers and the practice of polytheists. Muslims must beware of this dangerous phenomenon, and mosques must be free of graves, established upon tawhid (the oneness of Allah) and correct creed. Allah the Exalted said:
And [He revealed] that the masjids are for Allah, so do not invoke with Allah anyone.وَأَنَّ الْمَسَاجِدَ لِلَّهِ فَلاَ تَدْعُوا مَعَ اللَّهِ أَحَدًا
[Al-Jinn 72:18]
. Therefore, mosques must be for Allah, free of shirk (associating partners with Allah) and polytheistic manifestations, and the worship of Allah alone, who has no partner, must be performed in them; this is the obligation of Muslims, and success is from Allah.
