Ruling on bequeathing burial in a specific location

Machine translationRead the Arabic original
If a person bequeaths during his lifetime that he be buried in a designated place, is this bequest carried out? That is, upon his death, is he buried in the place he chose as his grave?
Answer: If the location is appropriate, such as saying, “In the Muslim cemeteries,” or “With the group in the group cemetery,” there is nothing wrong with it. However, if he bequeaths a specific spot in his house, or in another place, isolated from the people, then no, his bequest is not carried out. This is because burying in his house contradicts the prescribed practice, and it is a means for the grave to be desecrated or for excessive spending to occur there. Similarly, if he is alone in another place, it may be desecrated or excessive spending may occur there. But he should be buried with the Muslims in his country.
And if he bequeaths that he be transferred to another country, it is not obligatory to carry this out due to the burden, lack of necessity, and lack of legitimacy involved. Rather, he should be buried in the cemetery of his country if there is a Muslim cemetery, and he is buried with them. There is no need to transfer him to a place that incurs expense.
Or, transferring him there may involve another prohibition, such as being buried with people known for religious innovation, or known for disbelief and evil. He should not be buried with them. Transferring him to the known Muslim cemeteries in his country is sufficient, and praise be to Allah. There is no need for the heirs to burden themselves by transferring him to another country. Yes.
The presenter: In some areas, Your Eminence, the cemeteries are desecrated; they are places for roads, and animals pass over them. They have no maintenance, no walls, or anything similar. If a person bequeaths that he be buried away from such cemeteries, for example, in a farm far from the roads, what is your opinion in such a case?
The Shaykh: If a cemetery is available, he is buried in the cemetery, the Muslim cemetery. But if it is in the open or in a farm far from people, he is buried in a specific spot on the outskirts of the cemetery. He and those who die from his group and those around him are buried around the farm, so that it is far from desecration. It should be known, a prominent, known grave in the manner of graves. This is permissible. However, if it is in a place that is desecrated by water or by people walking on it or the like, then no. But whenever a nearby cemetery is found, he is transferred there so that he is not desecrated.
The presenter: So, if a person requests during his lifetime to be away from such cemeteries, is he correct?
The Shaykh: Which cemeteries?
The presenter: These cemeteries that are desecrated, which are roads...
The Shaykh: If a non-desecrated cemetery is found, he is buried in it. It is obligatory for the people of the town to protect their cemeteries, to protect them with a wall, or with a thorny fence, or with an iron fence, or otherwise, so that they are not desecrated. The government, may Allah guide them, has directed the municipalities here to maintain the cemeteries. They are maintained if they are written to about this and mentioned, and they maintain them, praise be to Allah. And if the people of the town cooperate and assist one another and do not need the government, that is better and more excellent.
The presenter: May Allah reward you.
