Q: Islam forbids hunting land animals for the one in ihram while he is in the state of ihram for Hajj or 'Umrah, and it also forbids eating the meat of the game if it was hunted for him. However, if it was not hunted for him, there is no harm in eating it, as stated in the hadiths. The question I pose to your eminence is: If a person hunts land animals while he is not in ihram, it is permissible for him to eat from it. If he then preserves some of the meat of the game by cutting it up or freezing it or by other means of preservation and storage, and then enters the state of ihram afterwards, does he eat from that meat considering it to be meat and not game, or is it forbidden for him considering it to be game that was hunted for him before he entered ihram and he preserved with him what remained of the game as meat? May Allah guide your steps.
A : The ruling on a person in the state of ihram for Hajj or 'Umrah eating from the meat of land game
falls into four categories, as in the questioner's inquiry, and the ruling for each category is as follows: First: The scholars are in agreement on the ruling indicated by the verse in Surat al-Ma'idah:[Al-Ma'idah 5:95] It is forbidden for a person in ihram to hunt land game while he is in the state of ihram, or to point to it or indicate it. Second: It is also forbidden for a person in ihram to hunt land game if another person who is not in ihram hunts it for him, according to the most correct of the two opinions of the scholars; based on the hadith of Jabir (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said: Jami` at-Tirmidhi 846Da'if (Darussalam) It was narrated by Ahmad and Abu Dawud and al-Tirmidhi and al-Nasa'i . Third: It is permissible for a person in ihram to eat from land game if another person who is not in ihram hunts it, not specifically for this person in ihram, and the hadiths regarding a person in ihram eating from the game of a non-in-ihram person are understood in this sense. Fourth: If a Muslim hunts land game while he is not in ihram, before entering the state of ihram, and he stores its meat, then enters the state of ihram, there is no harm in his eating from it; because he killed
the game before entering the state of ihram, so it remains on the original ruling of permissibility. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
