Q: I saw some pilgrims on the Day of Tarwiyah in the southern part of Mina cutting branches from trees to make miswak and using them, and one of them distributed some of them to the pilgrims. I also saw, on the eleventh day, that is, the first day of the days of Tashriq, a man who cut branches from a tree in Mina to make miswak from them. What is the ruling on cutting trees in Mina , and what is the ruling on accepting as a gift miswak that has been cut from the trees of the Sacred Precinct ?
A : It is not permissible to cut anything from the trees of the Sacred Precinct , whether for one in a state of ihram or for anyone else; because the Prophet (peace and blessings be upon him) said:
its thorns are not to be cut, its trees are not to be loppedلا يخبط شوكها ولا يعضد شجرها
Sahih Muslim 1355b
, narrated by Muslim . Therefore, whoever does any of that must repent to Allah (Mighty and Majestic) and not return to such an act. It is not permissible to accept as a gift miswak if it has been cut from the trees of the Sacred Precinct , because that constitutes approval and assistance in a forbidden act.
