The second question of Fatwa No. ( 19966 )
Q2: I heard a question on the phone, the text of which is as follows: A man set a bridal gift for his wife that reached the minimum threshold for zakah, but she did not receive it, and a lunar year of possession has passed over it. Does the woman have to pay zakah on it? The answer was: The woman's bridal gift is like her other wealth; zakah is obligatory on it when it reaches the minimum threshold for zakah and a lunar year of possession has passed over it. If it is a debt, its ruling is the ruling of a debt. The question now is: What is the difference between the mahr and the sadaq, and when is the mahr paid to the woman? According to my knowledge, the mahr is paid in the case of divorce or the death of the husband. I have been married to my cousin's daughter for 25 years, and by the grace of Allah, we live in peace. My uncle – may Allah have mercy on him – set a mahr for me
deferred mahr of approximately (five thousand dollars). Is this considered a debt in my liability that I must pay immediately, and is there zakah on it for this entire period? If there is zakah, who is it due from, the husband or the wife, and is it paid once immediately upon receipt? I am aware that I pay zakah on my wealth, praise be to Allah, and my cousin's daughter has not demanded this mahr from me, nor does she think about it. If I asked her to forgive me, she would do so, because she knows that what I have is for her and our children in our life and death. However, I want to act correctly and clear my liability if I am required to pay it to her immediately and without her asking for it.
A2: Any portion of the woman's mahr that is delayed in payment is considered a debt owed to her by the husband. He must pay zakah on it every year if it reaches the nisab or more, unless the husband is unable to pay or the mahr is deferred until divorce or death. In that case, zakah is not due on it until she receives it and a lunar year has passed over it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
